to support employees of Hitachi Energy (the company) or other group entities employed in the Canton of Geneva in coping with the economic consequences of old age, disability and death. The foundation may also pay relief benefits in the event of illness, accident or unemployment to the beneficiary, pensioner or any other person whose services the company uses or has used, as well as, in the event of death, to the surviving spouse, descendants or persons whom they supported. Relief benefits may only be paid if the person is in need or in a situation of distress. The foundation may also create special funds with a specific purpose within itself. Within the framework of the purpose defined in paragraph 1, it may in particular constitute reserves of future employer contributions to the company's employee pension funds. It may also provide temporary benefits to employees retiring before the age limit set by the Federal Old-Age and Survivors' Insurance (AVS). Furthermore, it may pay voluntary cost-of-living allowances to pensioners. The foundation may also make allocations to the company's other pension funds and to the pension fund in favor of active employees. Under no circumstances may the foundation's assets revert to the company, nor may they be used in whole or in part and in any way whatsoever for its benefit. The foundation may not make any payments that are incumbent on the company by law or contract, nor any other payments having the character of remuneration for work (family allowances, cost-of-living allowances, seniority bonuses, etc.).
