The cooperative can acquire, encumber, and sell properties for this purpose. When selling housing units, the cooperative ensures that the buyer cannot engage in speculative transactions. To exclude speculation, it can reserve voting rights in the sense of the Housing and Property Promotion Act (WEG), pre-emption or repurchase rights, and set binding maximum resale prices in the purchase agreements. The fixed maximum resale prices also apply in the event of the cooperative exercising its pre-emption or repurchase right. No pre-emption or repurchase right is granted to the cooperative in the event of a housing unit being transferred to relatives in ascending or descending order of the owner or to their spouse or a life partner (including same-sex partners). The cooperative maintains its buildings in good structural condition and renovates them periodically. Living space and the number of users should be in a reasonable proportion to each other. The cooperative can participate in companies with the same or similar objectives and acquire membership in umbrella organizations of non-profit building cooperatives.
